HUD recently released the final rule (24 CFR Part 891) in the Federal Register governing the use of funding for Section 202 Supportive Housing for the Elderly Program (Section 202) and the Section 811 Supportive Housing for Persons with Disabilities Program (Section 811) to streamline the requirements applicable to Section 202 and Section 811 mixed-finance developments.
HUD’s director of Multifamily Development, Theodore Toon, recently issued a memo to provide guidance on Federal Housing Administration (FHA) and MAP Guide policy regarding age restrictions in FHA-insured housing.

HUD recently released Notice 2013-17 to update and consolidate previous guidance on the prepayment of Section 202 Direct Loan projects. The Notice touches on guidance for HUD approval and processing of the prepayment of old (1959-1974) and new (1974-1990) Section 202 projects and supersedes guidance from previous Notices 2002-16, 2004-21, 2010-14, 2012-08.
On July 2, 2013 HUD issued its “Notice of Senior Preservation Rental Assistance Contracts Award Process” (Notice), which specifies the process by which HUD will award Senior Preservation Assistance Contracts (SPRACs). The Notice also starts the application process, and solicits applications for a period of 60 days.
The National Affordable Housing Management Association (NAHMA) recently released its Affordable 100 which ranks the largest affordable multifamily property management companies, ranked by affordable unit counts. In an effort to accurately determine the portfolio of affordable units receiving federal subsidy in the United States, NAHMA publishes this annual listing of affordable units containing at least one of the following federal subsidies: HUD Project-based Assistance, Section 42 LIHTC, HOME funds, USDA Section 515, or Bonds.Â

HUD recently released Notice H 2013-12 to update and replace Notice 2009-10, which defined the Department’s initial procedures for processing certain Section 202 Supportive Housing for the Elderly projects and Section 811 Supportive Housing for Persons with Disabilities under a delegated processing system.

HUD recently released a Federal Register Notice to solicit comments on the Senior Preservation Rental Assistance Contracts (SPRACs) awards processes. The Section 202 Supportive Housing for the Elderly Act of 2010, signed into law in January 2011, authorizes HUD to provide SPRACs with 20-year terms to prevent displacement of elderly residents of certain projects assisted under HUD’s Section 202 Supportive Housing for the Elderly program in the case of refinancing or recapitalization and to further preserve and maintain affordability of Section 202 Direct Loan projects.
