The Qualified Allocation Plan and Multifamily Rules Committee of The Texas Department of Housing and Community Affairs Governing Board will meet Wednesday, Sept. 6, 2017, beginning at 2 p.m. Austin local time, in Room JHR 140 of the John H. Reagan Building, 1400 Congress Ave., in Austin, Texas.

The meeting will not be broadcast on the Internet, but the transcript will be posted later at: http://www.tdhca.state.tx.us/board/meetings.htm.

The purpose of convening this Committee is to discuss the staff drafts of the QAP (further information in prior story below) and impact education as threshold per recent legislation (as of 8/30/17 no agenda item had been published regarding this item). August 16, 2017 — The Staff Draft of the 2018 Qualified Allocation Plan (“QAP”) has been posted to the Texas Department of Housing a Community Affairs’ (“TDHCA”) website on the Multifamily Finance Division’s Announcements page at: http://www.tdhca.state.tx.us/multifamily/announcements.htm and on the NOFAs and Rules page at: http://www.tdhca.state.tx.us/multifamily/nofas-rules.htm.

This DRAFT document has been prepared by TDHCA staff and has taken into account extensive input over the course of the year. It has NOT been reviewed with the TDHCA Governing Board nor has it had Governing Board member input.

Changes include:

  • Sponsor Characteristics: Up to 2 points rather than 1 awarded in this category and rather than 80%, now only a 50% ownership interest is required of the HUB or Qualified Nonprofit
  • Additional requirements regarding amenities for acquiring points within the Opportunity Index
  • Eligibility to Participate in USDA or Rural Set-Aside – allowing for specific projects to fit within this category regardless of whether the project is located in a rural area.

TDHCA welcomes stakeholder input on this Staff Draft. While this DRAFT creates an opportunity for discussion and stakeholder input, the input received will NOT be treated as “public comment” under the rulemaking provisions of the Administrative Procedures Act as it may or may not (depending on input) ultimately be the version of the rule presented to the Governing Board for publication in the Texas Register for official public comment.

TDHCA anticipates that at the Thursday, Sept. 7, 2017, Governing Board meeting a proposed form of the QAP and Rules will be presented for consideration and possible action to approve publication in the Texas Register. That will establish the official public comment period.
