Beginning on Feb. 1, 2022, Florida Housing will begin performing in-house compliance monitoring procedures for the Extremely Low-Income Link/Special Needs units in its developments. Properties with competitive Housing Credits units and SAIL units will have monitoring reviews conducted annually on a date established by Florida Housing.
Florida Housing staff shall review files to determine whether acceptable procedures for Link units are currently being followed. Owners and management companies shall submit files electronically for examination through Procorem.
Files to be examined are as follows:
- A copy of all active MOUs approved by the Corporation;
- Documentation demonstrating the development owner’s efforts to retain and maintain an executed MOU with a designated referral agency in the development’s county;
- The specified number of Link units that are occupied by a Link household;
- Record of contact between property and referral agency. Record of contact must include the following:
- Date the unit became available;
- Date notification to the referral agency was made;
- Name of referral agency;
- Number of days the unit was held; and
- Outcome of referral.
- A copy of any current correction period extension granted by the Corporation.
For occupied Developments (competitive Housing Credits and SAIL), monitoring reviews will be conducted on the date their previous review (whether initial or subsequent) was done.
Beginning February 1, developments with previous review dates in February will begin in-house annual monitoring requirements. For example, if a development’s last review date was 2/19/2018, the new annual review date will be 2/19/2022. If a development’s last review date was 1/7/2020, the new annual review date will be 1/7/2023.
Competitive Housing Credits: When a development is not occupied at the time of carryover, the monitoring review will be conducted on or before the 120th day after the placed-in-service date for the last building in the development. That date will become the date for subsequent annual reviews.
SAIL: When a development is not occupied at the time of loan closing, the monitoring review will be conducted on or before the 120th day after the leasing of the last SAIL unit. That date will become the date for subsequent annual reviews.
Florida Housing will hold a compliance training workshop on February 18. Register via this form. Both the completed registration form and $125 per-person fee (or $155 per person if a Compliance Guidebook is desired) must be received by First Housing on or before the February 4 registration deadline
