On January 8, 2018, the Department advised applicants wishing to score 10 points under 10 TAC §11.9(d)(3) related to Declared Disaster Area for Developments in counties for which the disaster declaration will expire prior to the March 1, 2018, Full Application Delivery Date that the Department’s Governing Board would take action regarding the full application delivery date for such applications.

At its meeting of January 18, 2018, the Department’s Governing Board made the following determinations:

  • An applicant may claim disaster points under 10 TAC §11.9(d)(3) if a complete application is submitted on or before two years from the date the disaster declaration was made under Tex. Gov’t Code §418.014.
  • In the case presented, the declaration was made on January 26, 2016, and the full application due date for applicants wishing to score 10 points under 10 TAC §11.9(d)(3) related to Declared Disaster Area for Developments in the counties included in that disaster declaration is January 26, 2018.
  • In order for such an application to be “complete” (which is an express requirement of the statute) the application and materials submitted by January 26. 2018, must include elected official support (local government resolutions and state representative letters) if points for such are to be requested.
  • Since the Board did not address changes in pre-application points in its order, applications whose final score (inclusive of only scoring items reflected on the self score form) varies by more than four points from what was reflected in the pre-application self score will not qualify for six points under 10 TAC §11.9(e)(3) related to Pre-application Participation unless a timely filed waiver to this rule is submitted and granted.
