HUD’s recent notice in the Federal Register extends the deadline for submission of Assessments of Fair Housing (AFH) past Oct. 31, 2020 (participants have varying specific deadlines). HUD reasons that local government consolidated plan program participants need additional time and technical assistance in adjusting to the new requirements. HUD bases its decision in part from evaluating the first 49 AFH submissions and finding that 35% of them were initially deemed non-accepted.
The extension comes on the heels of a Dec. 23 court ruling reversing HUD’s delay of implementation for Small Area Fair Market Rents – a suit filed by several fair housing advocate groups. In that case, the court held that HUD did not identify appropriate reasoning for the delay.
While fair housing advocates have not filed suit in this matter, a joint statement has been issued calling on HUD to reverse its decision in delaying AFH submissions.
